Estimates provided by Patterson Deck & Fence are based on information available at the time of the on-site visit and the scope of work discussed. A written estimate is provided before any work begins. If conditions are discovered during a project that require work outside the original scope - such as rotted framing, unstable soil, or hidden structural issues - we will notify you before proceeding and provide a written change order for your approval. We will not perform work beyond the original scope without your written authorization.
All prices are quoted in U.S. dollars. We reserve the right to update our pricing for new estimates at any time, but a signed estimate will be honored for the period specified in that document.
Project start dates are confirmed in writing once a contract is signed and any required deposit is received. Schedules are subject to change due to permit review timelines, weather, material availability, or other circumstances outside our control. We will notify you as soon as possible of any material delays.
If you need to cancel or postpone a scheduled project, please contact us in writing as soon as possible. Cancellation terms, including any applicable deposit retention, will be specified in the project contract. Deposits paid to cover permit fees or materials ordered specifically for your project may not be refundable.
Payment terms are specified in the project contract. Typically, a deposit is required at contract signing to cover materials and scheduling, with the remaining balance due upon project completion. We accept payment by check, bank transfer, or other methods as agreed in writing.
Balances not paid within the time specified in the contract may be subject to late fees or interest as permitted by California law. In the event of non-payment, we reserve the right to pursue all remedies available under California law, including filing a mechanics lien against the property where work was performed.
Patterson Deck & Fence obtains all required building permits for permitted projects as part of the agreed scope of work. Permit fees are either included in the project estimate or billed separately as specified in the contract.
You are responsible for obtaining any required approvals from your homeowners association (HOA) before work begins. HOA approvals are separate from city or county building permits. We are not responsible for delays or costs caused by HOA disapproval or required design revisions related to HOA requirements.
To the fullest extent permitted by applicable law, Patterson Deck & Fence shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our website, any errors or omissions in website content, or any delays or interruptions in service.
Our total liability to you for any claim related to services rendered shall not exceed the total amount you paid for the specific project giving rise to the claim. This limitation applies regardless of the theory of liability asserted.
This website and its content are provided "as is" without warranties of any kind, express or implied. We do not warrant that the website will be error-free, uninterrupted, or free of viruses or other harmful components.
Warranties for completed construction work, if any, are specified in the project contract. Material warranties are subject to the terms provided by each manufacturer. We pass through applicable manufacturer warranties to you but cannot warrant materials beyond what the manufacturer provides.
If a dispute arises between you and Patterson Deck & Fence related to our services or these Terms, we ask that you contact us first so we can try to resolve the issue directly. Most concerns can be resolved quickly with a direct conversation.
If a dispute cannot be resolved informally, you agree that any legal action arising from or related to these Terms or our services shall be resolved through binding arbitration or in a court of competent jurisdiction in Stanislaus County, California, as applicable. You waive any right to a jury trial or class action in connection with such disputes.
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings related to these Terms shall be brought in the appropriate courts of California.
